Most Common Grounds For Divorce

Ever wonder the roots why married couples split? How come they could dare to break their sacred vows to each other and put an end to their marriage in just a blink of an eye? Well, you can think of many.

However, on a legal basis, take note of these so-called common grounds in order to file for divorce. Some states in the U.S. even have varying numbers of grounds, or only offer no-fault divorce (other spouse does not have to prove any fault towards the other). You really need to hire a divorce lawyer annapolis md so you have someone reliable to properly guide you and knows how to protect your rights.

What are these grounds for? When a spouse wishes to file for divorce, he/she can choose among the numerous grounds to base their case.

The common official grounds for divorce:

1. Adultery

This is the most common ground of divorce. However, adultery is hard to establish because it requires compelling evidences which need to be defended and proved. Some jurisdictions even require a context of actual sexual intercourse. Why involve such process? In many states, a spouse who is proven to be guilty of adultery is the one mandated by the court to provide alimony or spousal support.

2. Irreconcilable Differences

Most no-fault divorce states grant divorce based on irreconcilable differences. A married couple need not to prove any misconduct, if both parties mutually agreed to end their marriage. Or could be that one spouse strongly refuse to reconcile with the other making the harmony of marriage impossible.

3. Cruelty

Cruelty is also considered an official ground of divorce which includes numerous issues as basis to call off a marriage legally. From the definition of the word itself, it considers anything that is painful and harmful towards an individual -- anything cruel and inhumane. These issues generally involve verbal and/or physical abuse, neglect of emotional and physical needs, alienation and so on. So if you want to ask if adultery is considered as cruelty, then the answer is yes, because it causes deep emotional and mental pain.

4. Abandonment

In order to qualify for this ground, two people must establish and prove that they have not lived together in a long time as a married couple. That is why in some states, abandonment is also referred to as willful desertion.

5. Separation

This ground is quite similar to abandonment. It only differs a little in the time period, which a couple must establish that they have not cohabited during such time. Time periods of separation varies depending what length a state requires but in can range from six and 12 months on the lower end to 18 and 36 months on the higher end.

Therefore, when you choose one among those grounds for divorce, be firm and take your stand. If you are obligated to provide statements, state it clearly and with conviction. This way, you can impose a good reputation and impression on the court.

Still, hiring a divorce lawyer annapolis md is greatly recommended. Looking for the most reputable and reliable divorce lawyers in Annapolis? Visit Wise and Donahue, PLC at 18 West Street, Annapolis, MD 21401 or just contact 410-280-2023.

The Importance of a Divorce Attorney

A divorce attorney will think about and investigate any possible problems that may come up during the divorce process. They will be looking for any unexpected legal issues that may become a challenge. Every case is different, so during your initial appointments, we will go over some of the things that you should anticipate and ensure that you are well prepared for what’s ahead.

1. Advise You of Your Options

All divorces are different and you may not realize the different options there are for requesting a divorce from the court. In some cases, you may go through a simplified divorce process if you and your spouse agree that all issues are uncontested. However, you still need to meet certain requirements for an uncontested case. You may also want to explore collaborative divorce, mediation, and other avenues besides traditional litigation. An attorney can help you decide which is best for your situation.

2. Identify the Issues that Need to be Addressed

Each divorce case will have different issues that need to be resolved before the divorce can be finalized by the court. Some couples may have a custody battle but may not own a home or much property. On the other hand, some spouses may demand extravagant alimony but they do not have any children. Some issues that may arise include:
  • Property division
  • Debt division
  • Alimony/spousal support
  • Child support
  • Child custody and visitation
  • Prenuptial agreement challenges
3. Protect Your Interests

It is only natural for each spouse in a divorce to want to face their future in the best situation possible. Unfortunately, this often comes at the expense of the other spouse and people can leave marriages in vastly uneven positions. You attorney will negotiate and argue for your best interests throughout the entire court process, including mediation, settlement negotiations, and court hearings to make sure you are not coerced into agreeing to a situation that is any less than you deserve.

4. Represent You in Court

Divorces can involve a number of court hearings and may even involve a trial if you and your spouse cannot agree on one or more issues. It is critical to have an attorney who is familiar with the family courts in your area representing you. Courts have strict rules and requirements and an attorney can present evidence in the most favorable light possible so that your rights are protected in court.

The most important decision you will ever make while going through the process of divorce is hiring an experienced divorce attorney. The topics and information mentioned above may be pressing but you will still encounter many more important aspects of divorce that must be accounted for in order to achieve a successful result.

Temporary Court Orders in a Divorce

If you already know the temporary court orders in a divorce, good for you then! But maybe you should review and refresh yourself to be sure.

However, if you don’t have any idea what are these “court orders” we are talking about, then you seriously need to read through this blog.

It is best to begin with the legal definition of “temporary court orders.” Well, it briefly refers to a short-term pre-trial temporary “injunction”--- a court order requiring a person to do or cease doing a specific action.

In divorce cases, specifically, there are quite a few temporary court orders that either of the parties can request to the court. What are these?

You can file for temporary orders for issues, including: legal decision-making and parenting time, child support, spousal maintenance, property, debt, and attorney’s fees.

Legal decision-making and parenting time: When seeking or request for a temporary legal decision-making, parenting time, or visitation order, you shall file and propose with the motion stating your specific parenting plan which includes the legal decision-making, parenting time, and visitation requested for all parties to the action.

Child support: When seeking or requesting for a temporary child support order, you shall include and file with the motion a completed a Child Support Worksheet clearly stating the amount requested in accordance with the current child support guideline in the area where your divorce case is being filed.

You shall also provide copies of all child support disclosure documents required by the court’s rule, to the opposing party within a certain period of time specified in the rule. Also, make sure to provide an additional copy of these documents to the court during an evidentiary hearing on the child support motion.

Spousal maintenance: When seeking or requesting for a temporary spousal maintenance order, you shall state the specific duration and your requested amount, then file an affidavit substantially similar to Form 2, or the Affidavit of Financial Information.

Property, debt, and attorney’s fees: When seeking or requesting for temporary orders prohibiting your husband/wife from your residence, community property division, or to order payment of debt, expenses, or attorneys’ fees, the motion shall contain the specific relief requested, the proposed division of property, the income and assets that will be distributed to each party, and the individual obligation to pay the debt, expenses, and attorneys’ fees to be granted by the court.

If you or your husband requests for a temporary order for payment of attorneys’ fees, either shall state the specific amount requested and file an affidavit substantially similar to Form 2, or the Affidavit of Financial Information.

To get a temporary order, you must also file an underlying petition before you file a verified Motion for Temporary Orders with the court. Without an underlying petition, the court will dismiss your Motion for Temporary Orders. However, you can file both at the same time.

Any temporary court order is in effect until there is another order by the court that replaces a certain temporary order.

Know more about the other issues concerning divorce that you might encounter along the legal process. You should hire the most reputable and experienced divorce lawyers in Annapolis, MD.

Divorce Attorney: Be First To File A Divorce

Does it really give you an advantage if you get to file for divorce first before your spouse?

Yes, there will be quite a lot of good things for you later on if your divorce case progress. Yet, this should not be your basis to immediately get a divorce. You may still try to settle personal matters between you and your spouse through counseling and other methods.

However, the moment your partner announces intentions for divorce, do not let your guard down by the shock. Keep your act together and start consulting a divorce attorney to properly guide you in filing for divorce and even make the job faster.

What are the advantages of being first to file for divorce?

1. You can make a divorce team and prepare in advance

When you aim for a favorable outcome in your divorce case, you should choose the best people for your team. It may take time to interview and assess the perfect match attorney, but then, it would be worth it in the end. Moreover, divorce usually involves high emotions, especially because you are dealing with a person who is once a family, so it’s better to hire a counselor or therapist. And when you are finished building a team, wisely use your time to prepare requirements, and plan strong strategies for your case.

2. You have necessary documents ready before the divorce process begins

Being in a complex legal case such as divorce, it surely requires a lot of documentation - which means, you’ll have to allocate a lot of time gathering all financial and legal documents. Preparing and copying all of them beforehand will save you from the hassles, compared when you work on it during the legal process. Commonly, the court will ask for bank and brokerage statements, tax returns, insurance policies, retirement account statements, real estate records and vehicle registrations.

3. You can prepare financially for your divorce expenses

The moment you realize that sooner or later you’ll be getting a divorce, you should start a separate savings as a preparation for your divorce. That way, you’ll have enough money to hire a credible and experienced lawyer. Moreover, your savings would help you survive an independent life in the future. If you get the chance and time to get a credit card, secure one as well.

4. You can prevent your spouse from hiding his/her assets

In most cases, a spouse tends to hide assets during the divorce process to prevent the other party from accessing it. Yet, when you get first to file for divorce, you can stop such situation from happening. But if not prevented, there are still legal ways to charge a penalty to your husband or wife.

5. Legal Advantages

Legally, when you get first to file for divorce, you are given the privilege to choose where your divorce will be judged. This way, you can have the hearing in a court where the hired  divorce attorney is familiar and very much confident. Most of the time, the first to file may be the first to present his/or case in the court as well.

Filing first may be a small act, yet it brings a huge impact in your divorce case. Well, this is how the legal process works, you have to give attention to every small detail and issue to come up with a better outcome.

What Your Divorce Attorney Should Be Doing

Since the law means order, your divorce attorney should also know the things he/she must do in a manner appropriate to legal regulations and restrictions regarding your divorce case.

Divorce can be complex and involves a lot of work. So expect that in every action that your lawyer will take, you have a role in all of it. But of course, you are not obliged to know the laws applicable for divorce because if that happens, getting a lawyer would be senseless.

Read through these guidelines of what your divorce attorney should be doing when handling your divorce case:

Your attorney should explain the game plan in your case during an initial consultation. After getting the initial information about your case, a divorce lawyer already has a task. He/She should clearly present a strategy according to your terms which he/she believes would be of great help for you.

Your attorney should have an overall plan. Apart from presenting the most effective strategy for your divorce case, your lawyer should also make a plan for the other aspects of the situation. He/She should have a plan of when to meet with your spouse’s lawyer to discuss a settlement, as well as a timeline to process all necessary documents to be submitted in the court.

Your attorney should avoid delays in processing your case. Primarily, to make sure that your divorce case be processed and handled well, choose a divorce attorney annapolis md who does not have a lot on hand. One who can dedicate a lot of time to work on your case to avoid delays and will not waste a lot of your time.

Your attorney should demand all financial documents from your spouse’s party.
Your lawyer should do his/her best to get a copy of any documents showing all assets, properties, employee benefit, or pension which should be rightfully divided between you and your spouse. Because in a case like this, you are always to gain something in the end - and that is money or financial support.

Your attorney should evaluate any expert needed in your case. If you need to hire an accountant to analyze your financial statements and assets, your hired divorce lawyer is responsible in assessing or even finding the most appropriate financial advisor or accountant for the case. He/She may give a list of qualified experts as well.

Your attorney should be a good spokesperson. If you are willing to listen and discuss with any settlement proposal or negotiation from your spouse, your lawyer will be the one to relay the message and tell the other party about your point of view.

Your attorney should immediately respond to letters and phone calls regarding your case. With all such communication, your lawyer should give you update on what is the call or message all about. A copy of the letter should be sent to you within 24 hours with the lawyer’s receipt.

Your attorney should fully prepare if your divorce case goes to trial. In the legal part, your lawyer should gather and interview witnesses and make sure to notify them in advance of the trial date. Now, expect that your lawyer will prepare you as well. He/She might tell you to visit the courtroom beforehand, brief you of the questions he/she plans to ask and what to expect during cross-examination.

Your attorney should be honest with you. A good lawyer will tell you frankly if you have lesser chance of winning the case, but then will give you a smart advice on what should be the better next step to take.

All the guidelines are quite achievable when you choose a credible and honest lawyer who is a good match for you and your case. Therefore, you should be wise first when assessing and finding a divorce lawyer to work with.

Divorce Attorney Annapolis MD: Important Queries to Ask

So, we have boiled down this important decision in your divorce into 5 steps to find a good divorce attorney for you. What exactly do you need to know before you hire an attorney? Here are some questions to ask before you sign the retainer cheque.

What is collaborative law and how can I use it for my divorce?

Collaborative law is a relatively new concept in divorce law that allows divorcing spouses to avoid contentious disputes in court. In a collaborative divorce, you and your spouse will agree up front not to go to court, and you will work closely with your divorce attorneys and subject-matter experts to come to an amicable resolution on all of the key aspects of your divorce.

Who will handle my case and how will tasks be delegated?

Attorneys in every state have an ethical obligation to advise you of any conflict of interest. Still, you should ask the question. If the lawyer’s representation of prior or existing clients would limit the attorney’s ability to represent you, there is likely a conflict. For example, if you want to sue a hospital that the potential lawyer regularly represents, there would be a conflict. A conflict might also arise if the attorney you are interviewing has already been hired by a co-defendant in your case. Not all conflicts automatically disqualify potential counsel, but you must be fully aware of and understand the nature of the conflict before deciding whether to hire a lawyer in spite of it.

What Can You Tell Me About Child Custody?

When you have children with your spouse, and are unable to privately agree as to who will retain custody, it’s important to understand from the outset which factors are important to state judges when deciding which parent to award custody to. Therefore, you should ask your attorney what your chances are of obtaining custody of your children. Since child custody issues sometimes prolong divorce proceedings, it’s best to know which issues are best to concede and which to challenge. You might also ask about alternative dispute resolution like mediation or arbitration if you feel going to trial is something you'd like to avoid.

What is Your Hourly Rate?

Find out what the divorce attorney hourly rate is, what the up-front retainer will be, whether any portion of the retainer is refundable if it is not used, and how often you can expect to receive invoices that detail their hourly charges and expenses. Insist on a contract signed by you and the attorney clearly outlining the fee agreement before contracting with an attorney.

If you can think of more, add them to this list. Your divorce attorney annapolis md is your legal advocate during divorce. Without asking the proper questions, you won’t know how well they will be able to advocate for you.

Are There Ways to Cut the Cost of My Divorce?

Begin by not making the divorce lawyer annapolis md your very own private therapist. If you truly are concerned about keeping your legal fees down, use your attorney for legal advice and legal counseling only.  Remember your legal counsel is a professional who will charge for his or her time. Use that time spent effectively and wisely and find empathy somewhere else. Do this by keeping track of the time spent on the phone or in court. Discuss immediately if you somehow find the charges not accurate.

After carefully weighing all of these issues and thoughtfully considering your needs, you should be able to make a decision on an appropriate divorce attorney. In the end, it may come down to just trusting your gut instinct and going with someone who you are comfortable with and who is a good fit for you.

Divorce Attorney Annapolis MD: How Should They Act In Court

In order to appear shipshape and knowledgeable during court trial, your divorce attorney should always act and speak accordingly. You don’t want to leave a not so good impression as the weaker party just because your lawyer does not dress well.

Here is some guide on how your divorce lawyer should behave in the court:

Straight to the point. A divorce attorney should be brief and straight to the point when stating pleadings for a motion, even when arguing. He/She should deliver clearly to the judge your interests and what you really want out of the case. Sometimes less is more, so it’s better that a lawyer only talk less and avoid steering the wheel to another direction.

Smart talker. When a lawyer represents a client in the court, he/she should be vigilant and wise in choosing his/her words, and should speak authoritatively. Because every information your party releases could be used against you.

Avoid redundancy. Your lawyer should avoid restating verbally what has been written in your motion because it might annoy the judge. Judges come to the court prepared by reading all written documents regarding your case. What your lawyer can do - is to expand the motion staying on point, of course.

Always prepared. As how the judges prepared, your lawyer must do more than just reading paperworks concerning your case. He/She should review documents and prepare evidences significant to your case beforehand to avoid misrepresentations or worst - embarrassing his/herself and you as as the client.

Well mannered. Your lawyer is still human. He/She still feel disappointed and upset if the judge does not agree or favor your case. However, a well mannered lawyer will remain courteous and respectful towards the person in position. This kind of act will only show that you are working with a credible and wise lawyer.

Appropriately dressed. Let’s go physical. Just like any other occasion, a trial also suggests appropriate fashion. Your lawyer can’t go to court in T-shirt and jeans, definitely not. I believe you already know that. Suits and ties are the best fashion when your lawyer started speaking about legal rules and articles. It leaves a positive impression to the people on the courtroom.

Punctual. Punctuality is one important thing to show people in the court that you and your lawyer is sincere and committed. Your lawyer should engrave the three most significant words in the legal world, “Be on time” and “Don’t keep the other party waiting”.

Keep an eye on the behavior and actions of your divorce attorney annapolis md because that helps with earning a good outcome out of your case. But of course, this should already be part of evaluating him/her during an interview - that if you’ve included it.

Other agents specialize in other fields that include personal injury, the family just to mention a few. A Proven Track Record

Moreover, the attorney needs to develop a significant presence in court to increase your chances of winning.

But there are great divorce attorneys who can help you at a very reasonable price. There can be times that a bankruptcy lawyer who keeps an unusually high charge quite unprofessional and off-putting. So, look for a professional who has reasonable charges and gives more personal attention to the case.

Divorce Attorney Annapolis MD: Common Reasons Why Married Couples Divorce

Sometimes a “‘till death do us part” end up with a “‘till divorce do us part”. Some marriage may be perfect, but others sadly end with a not-so-happy-ending, some married couples may stick together until the end but some only sticks together only for a year.

In the United States, 50 percent of first marriages and 60 percent of second marriages end in divorce.

Wondering why a lot of married couples broke up? Or how they end up with divorce or separation?

Take a look at these 10 common causes of divorce.

1. Infidelity

Either of the couple or both of them chose to cheat may be because of anger or lack of time for each other which leads to reduced emotional intimacy. Infidelity begins with a seemingly innocent friendship, says cheating expert Ruth Houston. “It starts as an emotional affair which later becomes a physical affair”.

2. Money

Money as one important part one’s daily living, greatly affects a marriage. Marriage also means being one - suggesting that both the person in a marriage should be honest about their financial capacity, goals, and spending habits. Yet sometimes that is not the case which causes a large gap between spouses.

3. Nonstop Arguing

A marriage is clearly not healthy when couples constantly arguing about nonsense stuff over and over again. This is because both of them are hunted by their perception of not being appreciated or recognized. This often happens when both spouses don’t know how to compromise. Because in a relationship - it should give and take, not give and, give or take and take.

4. Lack of Intimacy

Intimacy is a much needed ingredient in a marriage, it strengthens the connection between two people. Without connection, couples in a marriage tends to feel that they are not meant for each other. You can also show intimacy through physical and emotional ways, such as a hug before going to bed, a kiss every morning or just saying ‘I love you’ - it is not only about sex. Of course, both spouses are responsible in maintaining the fire in a marriage.

5. Unequal distribution of responsibilities

Lack of equality is also one cause of divorce because when one spouse start to feel that he/she is carrying most of the responsibilities in a marriage, it can reduce their respect for another spouse. Resentment and anger will take over and can lead to heavy arguments unless one partner will compromise and settle the problem peacefully.

6. Domestic Violence

When one spouse emotionally or physically abuse the other, it degrades the love and trust between them. In marriage, couples should be the first to prohibit abusive behaviour, especially if they have kids.

7. Getting married for wrong purposes

Not all people get married because of love because some of them only get in for money. The marriage started beautifully, but as time passes, one spouse will realize discontentment and emptiness.

8. Varying priorities and interests.

Actually, the differing interests and goals of spouses should not be a problem as long as both of them understand such differences. And with proper communication, they can even do each of their plans together.

The only thing that summarizes these causes is the inability of marriage couples to solve conflicts. Yes, being in a marriage is not easy because challenges will always be part of our life. When you decided to divorce, make sure to do it peacefully to avoid events you will regret in the end.

Divorce Attorney: Why You Really Need It

If separation is the only recourse for your marriage, then as a divorcing couple now is the right time to make sure that you have an experienced divorce attorney on your side throughout the process. Here are some key reasons why:

To eliminate the risks of mistakes that can be truly expensive at the very end. Due to spur-of-the-moment and emotional choices that were made without first consulting a lawyer, separating couples could make a blunder in issues from financial to parenting.

A legal representation will shed light on your marriage’s recent crossroad in a confidential, no-cost, no-obligation evaluation of your circumstances. Despite having no legal requirement in hiring a divorce lawyer for your divorce, you can know the advantages and disadvantages of having one in your side. There are even some alternatives for affordable legal help if you’re interested. More and more states are lowering the procedural walls so that they can help former partners file their simple uncontested divorce. Imagine having a sort of self-service center intended to allow warring couples to contest their union.

Having a divorce lawyer will take off the burden when it comes to facing tax issues. These matters need to be handled carefully. Most marriages which have lasted for several years will have entangled family assets that need to be carefully handled especially if some of them have increased value prior to your separation.

Even in the simplest of marriages, there will always be items of ownership that needs to be change. If you are going for a DIY divorce, the chances of you or your former partner missing on the legal matters surrounding this are high.

A divorce attorney in annapolis md will work for their clients to make things not get worse. He or she will make sure that their client is being treated fairly in the proceeding. Especially, as most divorce cases will get a little nasty as it moves forward. Have you hired a divorce lawyer who prefers settling matters in a friendly manner, or does he or she take the initiative to not fan the flame before it reaches the court? Obviously, you want a divorce lawyer who is going to get things done in the least aggressive manner, and avoid going to court.

Hiring the convenience of a divorce attorney is strictly up to your personal choices. But bear in mind, your divorce lawyer is set up to work with you like a coach who will help you think out the issues that come along the way. He or she will be there for you when you need information. Typically, your counsel will be available to file documents or argue your case for you if that later becomes necessary.

Your divorce attorney can help you focus on what the “big picture” of your separation is. He or she will create the best deal possible for you not to compromise any issues. He or she will find ways to have both sides come to an agreement where they can live with the settlement.

Why Your Spouse Has Changed His or Her Mind

A divorce does not happen overnight.

Haven’t you heard these stories before?

“We were together for 10 years, I was quite unhappy during the last three years of being with her.”

“My wife just came to me one day and said that she didn’t want to continue our life together anymore, and that something was really wrong with our relationship.”

“After getting married my job forced me to be separated from my husband in a 4 month period. A year after tying the knot we filed for divorce.”

“I started thinking about separation since 2001. It took me 5 years to verbalize it to her. I was surprised that it was that quick to say it and I immediately moved out of our apartment a week later.”

Noticeably, there is no such thing as a one-size fits all conclusion to the breakdowns seen in this union. But why do couples split up after so much time together? And how can you prevent this from happening in your marriage? Below is a list of reasons why a couples file for a divorce.

1. Being Unprepared For a Life of Marital Union

Some couples are not prepared for marriage. They blame the demise of their relationship for not being prepared for married life. Divorce is high especially during after the first seven years, hence, the term, the seven year itch. This suggests that happiness in a relationship declines after around year seven of a marriage.

2. Abuse

Another highly contributing cause to divorce rate is abuse. The abuse may start in little ways. Beginning with nasty comments and insults and will progressed finally to physical abuse after. Counselling is a great help but what if the promises to never hit her again will only continue to happen?

3. Couples Grow Apart

Do you constantly have nothing to say to each other? Are both of you looking at your phones? Are you really in a stage wherein there is nothing left to say to each other? Being indifferent to each other leads both of you to lose the spark and instead drift apart.

4. The Avoidance of Solving Problems

Couples tend to find a sort of distraction to avoid the troubles that comes in a marital union. They try to self-medicate individually. One will bury himself in a book while the other constantly just gazes on the television. If both of you will not take notice of what is going on around you, you will find yourselves facing each other in divorce court.

5. Intimacy Has Taken a Downward Spiral

Is intimacy a thing of the past in your marriage? Living in a marriage with a continuing decline in physical affection will lead to a doomed relationship. Your partner will realize that you are no longer showing concern for that emotional bond of being a husband and wife.

As a parting shot, a couple’s conflict revolves around two things: events that happened in the past and things that will happen in the future. Each spouse has his or her own brand of coping skills and sometimes too much begging and blaming and shaming will only fan the flame of the problem. Learn to handle each challenging situation carefully and stop pushing your spouse further away from you.

Phyllis Gates: Her Marriage to Hudson Had Fan Magazines Raving

Fan magazines took every chance to cover the story of the Gates and Hudson romance. From the detail of first meeting, to the first date to the romantic wedding.
Yet, there is more to the inside of their marriage that most people don’t know even the media. Gates even stated, ““The Rock Hudson you see on the screen is very romantic, but the Rock I lived with was not.”
People had known Rock Hudson as a perfect image of masculinity with that macho leading man look. He was the lead actor in the legendary film, “Giant and Pillow Talk” and the classic TV series, “McMillan and Wife”.
On the other hand, Phyllis Gates was a petite woman and very religious. She grew up on a 600-acre farm in Dawson, Minnesota. She worked as a secretary for Hollywood agent Henry Wilson, who happened to represent Hudson. That’s where they first met - in Wilson’s office.
